These Terms & Conditions ("Terms") govern your access to and use of the Instant Masseuse website
located at www.instantmasseuse.com (the "Site") and any related features, content, tools, and services
we provide (collectively, the "Services").
These Terms apply to all users, including customers ("Customers") and massage providers
("Providers"). By accessing or using the Services, you agree to these Terms. If you do not agree, do
not use the Services.
1) Who We Are
"Instant Masseuse", "we", "us", and "our" refer to Instant Masseuse Inc.

2) Marketplace Platform - Not a Massage Provider
Instant Masseuse is a marketplace technology platform that connects Customers with independent
Providers.
• Instant Masseuse does not provide massage services.
• Providers are independent third parties and are not our employees, agents, partners, or
representatives.
• Providers control how they perform services and are responsible for the services they provide.
3) Eligibility
You must be at least 18 years old (or the age of majority where you live, whichever is higher) to use the
Services.
You may use the Services only for lawful purposes and in accordance with these Terms.
4) Accounts (Required) and Security
To use the Services (including requesting or booking a massage), you must create an account and
provide accurate, complete, and up-to-date information. You agree to keep your account information
current.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under
your account. If you believe your account has been compromised or accessed without authorization,
send a message on our Support Page promptly.
5) Pricing (Instant Masseuse Sets Prices)
Instant Masseuse sets the prices displayed on the Site for bookings made through the Services. Prices
may vary based on factors such as service duration, location, distance, availability, and operational

The price shown at checkout is the price that applies to that booking at that time (unless the booking is
cancelled or refunded according to these Terms).
6) Bookings, Cancellations, No-Shows, and Late Arrivals
6.1 Booking Confirmation
A booking is confirmed only when the Services show it as confirmed and/or you receive confirmation
through the Site and/or email/SMS (if enabled).
6.2 Customer Cancellations (Allowed Until Appointment Start Time)
Customers may cancel a booking any time before the scheduled appointment start time using the
booking flow (or by contacting support through the Support Page if needed).
If cancelled before the appointment start time, we will process a cancellation/refund as applicable
through PayPal. Please note that PayPal or your financial institution may take time to reflect the refund.
6.3 No-Shows / Cancellation After Start Time
If the Customer is not available at the appointment start time (for example, does not answer the door,
cannot provide access, or is unreachable), the booking may be treated as a no-show.
No-shows may result in warnings, booking restrictions, suspension, or termination of the Customer’s
account.
6.4 Late Arrivals
If the Customer causes a late start (for example, due to access issues), the session may be shortened
so the Provider can keep their schedule. No refunds are provided for time lost due to Customer-caused
delays, except where required by law.
6.5 Provider Cancellations
Providers should provide reasonable notice if they need to cancel. If a Provider cancels, Instant
Masseuse may offer the Customer a rebooking option or a refund depending on availability and
circumstances.
6.6 Provider No-Show / Failure to Attend
If a Provider fails to attend a confirmed booking without reasonable notice, it may result in warnings,
booking restrictions, suspension, or termination of the Provider’s account, and the Customer may be
offered a refund or rebooking.
6.7 Policy Updates
Instant Masseuse may update booking rules and enforcement measures from time to time by updating
these Terms and/or the booking flow. Updated rules apply going forward.
7) Payments (PayPal)
7.1 Payment Processing
Page 2Payments are processed through PayPal. By using the Services, you also agree to PayPal’s terms and
policies. Instant Masseuse is not responsible for PayPal outages, holds, disputes, account limitations,
or other PayPal actions.
7.2 Disputes and Chargebacks
If a Customer initiates a PayPal dispute or chargeback, Instant Masseuse may investigate and may
temporarily pause payouts and/or access to the Services while the dispute is reviewed. We may
request information from Customers and Providers to help resolve disputes.
8) Credentials and Verification (We Do Not Verify)
Instant Masseuse does not verify Providers’ credentials, licensing, certifications, insurance,
background checks, training, or identity documents unless explicitly stated otherwise on the Site.
• Customers are responsible for deciding whether a Provider is suitable for their needs.
• Providers are responsible for complying with all applicable laws, regulations, and professional
requirements.
9) Provider Responsibilities
Providers agree that they will:
• provide services lawfully and professionally;
• only perform services they are qualified and legally permitted to provide;
• follow all applicable laws, regulations, and professional standards;
• not misrepresent credentials, identity, or experience;
• maintain appropriate professional boundaries and respectful conduct;
• keep Customer information confidential except as required to perform the booking or by law.
10) Customer Responsibilities
Customers agree that they will:
• provide a safe and respectful environment for in-home services;
• provide accurate access/location information;
• communicate respectfully and avoid harassment, threats, or discriminatory conduct;
• not request illegal services.
11) Zero Tolerance: Illegal Activity and Sexual Services
Instant Masseuse does not permit use of the platform for sexual services, solicitation, harassment,
human trafficking, or any illegal activity.
We may suspend or terminate accounts and may cooperate with law enforcement where appropriate.
12) Safety and Emergencies
Page 3You are responsible for your own safety and decisions. If you feel unsafe, end the interaction and
contact local emergency services. In an emergency, call 911.
Instant Masseuse may suspend accounts, cancel bookings, or restrict access to address safety
concerns.
13) Prohibited Use
You may not:
• use the Services for illegal activity or sexual services;
• harass, threaten, stalk, or discriminate against others;
• impersonate others or provide false information;
• attempt to hack, scrape, reverse engineer, or disrupt the Services;
• upload malware or harmful code;
• violate intellectual property rights.
14) User Content (Reviews, Messages, Uploads)
You may be able to submit content (e.g., reviews, messages). You retain ownership of your content,
but you grant Instant Masseuse Inc. a worldwide, non-exclusive, royalty-free license to use, reproduce,
display, distribute, and otherwise use your content for operating, improving, and promoting the
Services.
We may remove content that violates these Terms or is inappropriate.
15) Intellectual Property
The Services, Site design, branding, and content (excluding user content) are owned by Instant
Masseuse Inc. or its licensors and are protected by intellectual property laws. You may not copy,
modify, distribute, or create derivative works from our materials without written permission.
16) Privacy Policy (Embedded)
This Privacy Policy explains how Instant Masseuse Inc. collects, uses, and shares personal information
when you use the Services.
16.1 What We Collect
We may collect:
• Account information: name, email, phone number, and account settings.
• Booking information: appointment details, service selections, and booking-related communications.
• Service location information: address and access instructions needed for in-home bookings.
• Support communications: messages and information you provide to support.
• Technical data: IP address, device/browser data, log data, and cookies/similar technologies for
security and site performance.

information such as payment status and transaction identifiers.
Please do not submit sensitive medical information through the Services. If you choose to include
optional notes, you do so at your discretion.
16.2 How We Use Personal Information
We use personal information to:
• create and manage accounts;
• facilitate bookings between Customers and Providers;
• provide support and respond to requests;
• maintain safety, prevent fraud, and enforce these Terms;
• send transactional messages (e.g., booking confirmations/updates);
• improve and maintain the Services.
16.3 How We Share Personal Information
We may share personal information with:
• Providers and Customers as needed to complete bookings (e.g., booking details and service
location/access info);
• PayPal to process payments;
• service providers who help us operate the Services (e.g., hosting, security, communications) under
confidentiality obligations;
• legal/safety authorities or advisors where required by law or to protect rights and safety.
We do not sell personal information.
16.4 Retention
We retain personal information only as long as reasonably necessary for the purposes described
above, including legal, accounting, dispute-resolution, and safety needs.
16.5 Security
We use reasonable safeguards designed to protect personal information. However, no method of
transmission or storage is completely secure.
16.6 Access and Correction
You may request access to, or correction of, personal information we hold about you, subject to

16.7 International Processing
Our service providers may store or process personal information outside your province or outside
Canada. Where this happens, your information may be subject to the laws of those jurisdictions.

The Services are not intended for individuals under 18, and we do not knowingly collect personal
information from anyone under 18.
16.9 Changes to This Privacy Policy
We may update this Privacy Policy from time to time by posting an updated version within these Terms
and updating the "Last Updated" date above. Continued use after changes means you accept the
updated Privacy Policy.

17) Disclaimers
Platform disclaimer: Instant Masseuse Inc. is a marketplace platform and does not provide massage
services.
No warranties: The Services are provided on an "as is" and "as available" basis. To the maximum
extent permitted by law, we disclaim all warranties, express or implied, including merchantability,
fitness for a particular purpose, and non-infringement.
Health disclaimer: Massage services are not medical care. Customers should consult a qualified
healthcare professional regarding medical conditions. Providers are responsible for operating within
their lawful scope.
18) Limitation of Liability
To the maximum extent permitted by law:
• Instant Masseuse Inc. will not be liable for indirect, incidental, special, consequential, exemplary, or
punitive damages, or loss of profits, data, goodwill, or business interruption.
• Instant Masseuse Inc. is not responsible for the acts, omissions, conduct, or services of Providers or
Customers.
To the maximum extent permitted by law, Instant Masseuse Inc.’s total liability for any claim related to
the Services will not exceed $100 CAD.
Some jurisdictions do not allow certain limitations. Nothing in these Terms limits rights that cannot be
limited under applicable law.
19) Indemnification
You agree to defend, indemnify, and hold harmless Instant Masseuse Inc. and its officers, directors,
employees, and contractors from any claims, damages, liabilities, losses, and expenses (including
reasonable legal fees) arising from:
• your use of the Services;
• your violation of these Terms;
• your interaction with any other user;

20) Suspension and Termination
You may stop using the Services at any time.
Instant Masseuse Inc. may suspend or terminate your account or access to the Services at any time,
with or without notice, as permitted by law, including if we believe you violated these Terms, created
risk, or engaged in unsafe conduct.
21) Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on the Site with a
revised "Last Updated" date. Continued use after changes means you accept the updated Terms.
22) Governing Law and Venue
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada
applicable therein.
Any dispute will be brought in the courts located in Toronto, Ontario, and you consent to that
jurisdiction, except where prohibited by law.
23) Electronic Communications
By using the Services, you consent to receiving communications electronically (email, SMS, or in-app).
You may opt out of marketing messages where required by law, but transactional messages related to
bookings and account activity may still be sent.
